In late 2025, several hundred farmers and landowners, including some CLA members, filed a judicial review into the conduct of Green Generation Energy Networks Cymru limited (GGC). This case relates to GGC’s use of statutory powers of entry for surveys in preparation for a possible compulsory purchase of ground for electricity pylons. At a hearing on the 20th January, the judicial review was allowed to proceed on grounds of, among other matters, possible activity outside of GGC’s legal powers and possible breaches of international human rights law.
You will hear from Mary Smith from New South Law and members of the claimants’ legal team who will explain some of the arguments made in this case. They will cover the grounds for review, a separate ongoing Alternative Dispute Resolution (ADR) process, the possible implications of situation for members elsewhere in the UK and Mark Burton, CLA Cymru Infrastructure Policy Adviser will explain the CLA’s involvement in this case and compulsory purchase more widely.
Discussion will then move to the importance of public and human rights law in compulsory purchase matters. There are laws which govern how public and quasi-public bodies must conduct themselves in general. The panel will explain why this broader legal field is important alongside the law specific to compulsory purchase when ensuring fair treatment of members by acquiring authorities.
